Under lead defense lawyer Vincent J. Fuller's direct examination, Tyson claimed that everything had taken place with Washington's full consent and he claimed not to have forced himself upon her. When he was cross-examined by lead prosecutor Gregory Garrison, Tyson denied claims that he had misled Washington and insisted that she wanted to have sex with him. "In a misguided attempt to show that Washington must have known that Tyson wanted sex, the defense called witness after witness to testify about their client’s lewd remarks and crude behavior during his encounters with the Miss Black America contestants, and even with Washington herself." Former attorney Mark Shaw argued that Tyson's "case was mishandled, citing a jury-selection process that allowed a conservative ex-Marine to become foreman, a defense "strategy" of making Tyson look as bad as possible, and a disastrous decision to allow the defendant to testify at the grand jury hearing, the trial, and his sentencing."

In his prime, Tyson rarely took a step back and had never been knocked down or seriously challenged. In 1986 Mike Tyson became the youngest boxer ever to win a world heavyweight championship title. Dubbed "Iron Mike" by the press because his physique made him seem invincible, he was hailed as the long-awaited successor to Muhammad Ali. He was later demonized in the same media after a series of personal and legal problems made headlines. Though he was considered one of boxing's most promising talents, mastering the fortune and fame that came with success proved to be Tyson's toughest challenge in life.

Tyson made yet another comeback in a match in January 1999 against Francois Botha, another controversial and ill-tempered match that Tyson eventually won. Just a month later, Tyson returned to jail, this time on assault charges, for nine months. He returned with a no-contest decision in his first match, but won two of three of his 2000 bouts, both by TKO, before finishing with another no-contest -- despite an initial win in that last bout, the result was changed after Tyson tested positive for marijuana in a post-fight urine test. In his only match in 2001, Tyson earned a seventh-round TKO against Brian Nielsen.

By the time he was 20, Tyson had a 22-0 record, 21 of those fights won by KO. A year after his mentor died, in 1986, Tyson was given the chance they both had worked for: his first championship fight, against Trevor Berbick. In just the second round, Tyson knocked out Berbick and won the World Boxing Council heavyweight championship. He also became the youngest heavyweight champion in history, at just 20 years and four months.

Lawsuits can even be brought when the characters’ names and story details have been changed. US army sergeant Jeffrey Sarver, the bomb-defusing expert who inspired the Oscar-winning film The Hurt Locker, sued the film’s producers for violating his right of publicity. He lost.

Legal analyst Mark Shaw said Fuller's argument was akin to "Mike Tyson is basically the worst human being on the face of the earth, ladies and gentlemen of the jury, and so should have known better than to go up into the hotel room."
